Seven conditions, one of them belonging to a society

Aptitude certificate, proof of marksmanship, insurance, a valid hunting pass — and membership of a hunting society.

Paragraph 12 KJSG lists seven cumulative conditions for hunting: being of sound judgement and of age, having acquired a recognised hunting aptitude certificate, having proved marksmanship, being a member, guest or warden of a hunting society, being insured under federal requirements, not being excluded from hunting, and holding a valid hunting pass. The fourth condition surprises a hunter arriving from a licence canton: in Lucerne you do not hunt alone. The tie to a society constitutes the right. A guest may hunt in the society's territory, but only in the company of a leaseholder or on their instruction. The cantonal government appoints an examining board, issues the rules on training and on obtaining the certificate, and governs the recognition of out-of-canton and foreign certificates. Proof of marksmanship must be given at an officially approved hunting range or at an officially admitted shooting event. Exclusion from hunting is ordered for between one and ten years, among other things for demonstrably false declarations of game taken.

Seasons

Shorter periods than federal law allows

The ordinance narrows hunting times for six species and permits drive hunts only from 1 October to 15 December.

The cantonal hunting ordinance (SRL no. 725a) narrows, for six categories of game, the periods federal law would allow. Roebuck and yearling doe may be hunted only with the bullet, from a stand or by stalking, from 1 May to 30 September; from 1 October to 15 December bullet and shot are both allowed. The adult doe follows the same pattern, bullet only from 1 to 30 September. Roe fawn is open from 1 October to 15 December, brown hare from 1 November to 15 December, chamois from 1 September to 15 December, and red deer from 1 August to 15 December. Otherwise the federally fixed protection and hunting times apply. Drive hunts may only be held from 1 October to 15 December. The agriculture and forest office may nevertheless allow them before 1 October and after 15 December, outside the federal protection periods, to fulfil the culling plan or to regulate wild boar numbers. Only two cases escape the ban on night hunting: the winter stand hunt for predators and the stand hunt for wild boar.

Lucerne: the regale is exercised by leasing the territories

Hunting is a state regale; the canton grants the right to hunt by leasing the hunting territories for eight hunting years.

Paragraph 3 of the cantonal hunting act (KJSG, SRL no. 725) of 4 December 2017 sets two rules in two lines: hunting is a state regale, and the canton grants the right to exercise it by leasing the hunting territories. The cantonal territory is accordingly divided into hunting territories, which the competent office delimits on hunting and wildlife-biology grounds after hearing the municipalities and the hunting societies. Each territory is given an assessed value, set before every lease from indicators on the huntable area, on the habitat potential for wildlife, and on the significant factors that reduce hunting value. The territories are publicly tendered by the competent office and leased, on the canton's behalf and through the territory's municipality, to hunting societies for eight hunting years. The hunting year runs from 1 April to 31 March, and subletting is excluded.
